Courts can quash law against constitution: CJP








CJP Iftikhar Mohammad Chaudhry said courts have power to revoke any law against the constitution.

During a law conference in Sukkur, Chief Justice said that it is responsibility of the courts to have a check on government and other intuitions during implementation of law and order.

Moreover, he said that constitution gives protection to the fundamental rights and the court is working for peace and stability in the society with the help of bar and bench.

He said the judiciary as the third pillar of the State in a constitutional and democratic dispensation, operating under the system of “separation of powers”, is required to define and interpret the law and the constitution. Besides interpretation of law, the judiciary is also required to dispense justice by resolving conflicts and deciding disputes.

He further added that the primary objective before judiciary is to restore and maintain peace, security and tranquility in society. It is to encourage trade, business and commercial activities and attract foreign/local investment. This is the surest way to advance and develop, and to achieve technological, industrial and commercial progress.

CJ said the courts undoubtedly adhere to law/constitution, thereby encouraging good governance and clean administration. In constitutional democracies like Pakistan, the Courts play an important role to ensure that the state institutions and authorities fully comply with the constitution.

Emphasising on cordial relations between the bench and bar the CJ said the Bench and the Bar are the two pillars on which the edifice of justice rests. Both the judges and the lawyers are involved in the process of dispensation of justice and in building a credible and efficient judicial system, which enjoys public trust, confidence and respect.

He also expressed his concern on the falling standard of education in the country.

Chief Justice Iftikhar Mohammad Chaudhry also added that the law conference would also be beneficial for the solution of various problems.
